1. Warranty Mode

For any material or functional flaw or defect found in all products during the warranty period, MEMPIRE promises to provide maintenance service or new product replacement.

2. Limited Warranty

The warranty clauses are not applicable to product damaged by any non-natural factors or external factors. In these cases, MEMPIRE shall not be liable for any data in the storage products; MEMPIRE Warranty Policy for storage products shall not be applicable in the following cases:

(1) Any fault caused from natural disaster, human disoperation rather than any intrinsic factors of the product;

(2) A product is repaired or disassembled by any person or technician not authorized by MEMPIRE;

(3) The warranty label or anti-disassemble alert is altered, damaged or lost;

(4) The product series number is damaged, illegible or not in accordance with requirement;

(5) The product is purchased from any marketing channels not authorized by MEMPIRE.

3. Disclaimers

(1) MEMPIRE is responsible for product maintenance and inspection only, excluding the rescue or backup services for data stored in our products. MEMPIRE shall not be liable for any loss of data stored in our products for any reason.

(2) MEMPIRE shall not be liable for any defect or damage of product or data loss for any reason caused from transportation for repair. It is recommended that you should keep a backup of all data stored in our product and delete the data before sending it to repair.

(3) To the greatest extent of applicable law, MEMPIRE shall not be liable for any users’ profit loss, expected cost loss, data loss, or other indirect, accidental or derived loss or damage caused by the use of our products.

(4) MEMPIRE products are not designed for high-security applications. We suggest you not apply our products to the life-support equipment or other equipment which may lead to personal casualty due to its defect or fault of the equipment, including but not limited to medical devices or relevant devices, military devices or relevant devices, aircraft, traffic control equipment, disaster prevention system, combustion control system or nuclear power equipment. MEMPIRE will not be liable for any personal casualty or loss caused by or related to the above applications of our products.

Other Statements

The warranty clause above is sole and complete, which supersedes all other agreements, oral or written, without guarantee for any merchantability or specific purpose of this product not mentioned herein, whether expressed or implied.

If specific national/regional laws set time limit for product warranty period, MEMPIRE will provide local consumers with necessary technical supports and warranty service to the full extent permitted by these national/regional laws.

If implied warranty liability is not allowed to be excluded by the specific national/regional laws, MEMPIRE only acknowledges that the implied warranty is valid in the said nation/region in the warranty period.

4. Applicable Objects

MEMPIRE Warranty Policy is only applied to the customers who purchase our products through legal marketing channels.

5. Duration of Warranty

Solid State Disk:

All series of MEMPIRE Solid State Disks have three-year warranty period. Free maintenance service is available for products damaged by natural factors in warranty period.

6. Others

(1) Before you send the product which has storage function to repair, please backup the data stored. MEMPIRE will not guarantee to keep the integrity of data while under repair.

(2) As partial products sent for repair shall be replaced by spares, the repaired products may not be the same one as before.

(3) In case certain production is halted or original factory dose not provided maintenance service any more due to elimination of the product, MEMPIRE will replace it with equivalent “substitute”.

(4) If the authorized center has no spares for replacement, MEMPIRE will replace it with product of same specification or send it to repair for consumer; MEMPIRE will not provide substitute with different capacity nor provide the time limit of wafer.

7. Warranty Claim Procedures

Submit application through channels:

You can return the defective or faulted product to the purchase point where you bought the product, MEMPIRE authorized dealer or agent. Please read the Warranty Policy before you return product. Generally, you must provide identification information of product such as product model and series number (if applicable) and describe your problem as detailed as possible. Besides, you must offer the supporting document marked with initial purchase date to prove the product is in the specified warranty period.

You are required to send the product to MEMPIRE Logistic Center within thirty (30) days after you get the RMA number from MEMPIRE. You will bear the premium and transport cost related to the returned product. The returned product must be properly packed to avoid damage in transportation. The RMA number of MEMPIRE must be highlighted on outer package of product. If you send the product to our logistic center without highlighting RMA number on outer package, MEMPIRE will return the package to you without any treatment.
